Before developing explicit conditions, employers should be familiar with relevant laws, such as. B.dem workers` statute, rules on written information, equal pay and minimum wage, temporary and part-time work, work flexibility, parental leave and working time. The explicit conditions must comply with all legal minimum standards, such as the right to paid leave and the right to daily and weekly rest. Employees who work at night benefit from special protection within the meaning of the BCEA. Night work means work done between 6 p.m. and 6 a.m. the next morning. An employer may only require a worker to work at night if there is an agreement with the worker (e.g.B. in the employment contract), the worker receives an allowance (which may be a shiftwork allowance) or a reduction in working time and when transport between the worker`s home and the place of work is available. ICPD members can find more details in our questions and answers on the Status of Employees Act.
The employment contract is concluded as soon as you accept a job offer. If you start working, it turns out that you have accepted the work under the conditions proposed by the employer, even if you do not know what they are. . . .
